This Privacy Policy applies to information collected about you (“personal information”) by A&W Restaurants, Inc. (“we”, “us” or “our”). We know how important your privacy is to you and we're committed to protecting the privacy of our visitors and clients.

Information you provide
You may be asked to provide information to us through one or more services we provide through our websites, embed within messages to you, within social media, or otherwise. This information may include personally identifiable information, such as, for example, your name, birth date, email address, address, and telephone number.
Information obtained through use of services
We may collect information provided by you and your computer through use of our services, including this websites, embedded within messages to you, within social media, and otherwise. This information may include the following types of information:
- Logging Information. We may automatically obtain and store HTTP header, information obtained from client-side tracking objects, information specific to your device, and other information obtained through our server logs upon your use of our services.
- Mobile Information. We may obtain information specific to mobile activity through use of our services, such as, for example, your location, your mobile device type, and the capabilities of your mobile device.
- Social Media. When interacting with our services within social media, we may obtain information stored within social media or authorized by you to be collected by us within such social media. This information may include your contact information, photos, email address, friend information, friends and pages with whom you have an association, and other information stored within social media.
- Cookies. We use cookies and clear GIFs on our websites. “Cookies” are small pieces of information that a websites sends to a computer’s hard drive while a websites is viewed. We use first party cookies on our websites, which allow our websites to function properly and allow us to conduct analytics. We also participate in behavior-based advertising, meaning that we may permit third parties to use technology (e.g., a cookie) to collect information about your use of our websites so that they can provide advertising about products and services tailored to your interests on our websites or on other websites.
Email Tracking
In order to determine a user’s ability to receive HTML email in addition to whether or not an email has been opened, A&W Restaurants, Inc. includes a “web beacon” in a majority of the HTML email messages we send. A web beacon (actually a small .gif image) is activated when an HTML email is opened via a request for the image on our servers. This capability helps A&W Restaurants, Inc. send email in a format users can read and enables A&W Restaurants, Inc. and our clients that use the functionality, to track the aggregate number of emails opened. The web beacon does not collect any personally identifiable information. Users that do not want to receive email messages with web beacons can choose to receive their emails in text (non-HTML) format. We also use, and provide our clients with, the capability to track when a URL has been clicked inside of an email message sent by our system. We use this functionality to track which links were clicked and in what quantity, as well as the aggregate number of links clicked. This click tracking functionality does not collect any personally identifiable information.
Additional Categories of Collection
In addition to purposes and uses described elsewhere in this policy, we use information in the following ways.
- At times we will use your HTTP header information to help diagnose problems with our server and to administer our websites.
- We also may track browser types to help us understand our visitors’ needs related to our websites design.
- There is an optional section of our websites where input forms require your name, phone number, company, birth date and e-mail address. This form provides the ability to opt-in to receiving future emails of any sort from A&W Restaurants, Inc. If you opt-in to receiving email communications from us, then we may send information to you on our products or services. This information will not be used for any other purpose.
- We do, however, reserve the right to disclose your personal information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our websites.

How we share information

Sharing excludes text messaging originator opt-in personal information and consent; this information will not be shared with any third parties.

Your Choices

We may take steps to verify your identity, before we act on your request exercise your right. We may ask for such information as your first and last name, email address, and country of residence to verify your identity. If we believe we need further information to verify your identity, we may ask for additional information. We may send a verification email to the provided email address to verify your identity. If you ask us to provide you with specific piece of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of your request.
In some circumstances, you may designate an authorized agent to exercise certain privacy rights on your behalf. If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of a signed authorization letter which shows that you may act on another’s behalf.
For California Residents: Sensitive Information Disclosure. We do not collect any sensitive personal information (as defined under California law) and we do not “sell” or “share” sensitive personal information for cross-context behavioral advertising.
Other Information
Retention and Security
No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.
We keep your personal information for only as long as necessary to fulfil the purposes in this Notice unless a longer retention period is required or permitted by law. This includes the purposes of satisfying legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information. We also weigh the potential risk of harm from unauthorized use or disclosure of the personal information, the purposes for which we obtained the personal information and whether we can meet those purposes through other means, as well as applicable legal requirements.
